On 18 July 2003 (BS 22 August 2003) a decree regulating the strategic advisory councils was adopted. That framework decree provides for one strategic advisory council to be set up for each policy domain. In addition, the decree lays down a number of general principles of functioning and advisory practice. Each advisory council has its own founding decree. On 9 May 2007 the Flemish Parliament approved the decree establishing the Flemish Foreign Affairs Council.

On 19 October 2007 the Flemish Government took a number of decisions to set up the Flemish Foreign Affairs Council:
 

• the decree of 16 May 2007 on the establishment of the Council became operational;
• the president and members of the Council were appointed;
• the attendance fees of the members of the Council were determined.
